Ratio Decidendi

The sale agreement and transfer documents dated 18th June 2015 were not executed by the deceased, rendering them invalid. Consequently, the registration of the 1st defendant as proprietor and subsequent transfer to the 2nd defendant were nullities. The 2nd defendant was not a bona fide purchaser for value without notice, given his prior dealings and knowledge of the dispute. The plaintiff is entitled to restoration of title, damages for trespass, and costs.
