The respondent's own internal regulations and the Employment Act require fair procedure and hearing before dismissal, which were not followed. The court held that the claimant's actions did not amount to gross misconduct warranting summary dismissal, and that the procedure used was unjustified and wrongful. The dismissal was therefore unfair and was converted to a normal termination, entitling the claimant to compensation and terminal benefits.
