The evidence did not sufficiently establish the nature and intensity of light at the scene or in the matatu, nor did it clarify whether the complainant could reliably observe the assailant. The complainant admitted not informing the police that he had identified the assailant, further undermining the prosecution's case. Additionally, the appellant's alibi defence was not considered by the trial magistrate, and since it was not rebutted by the prosecution, the appellant was entitled to an acquittal. The conviction was therefore unsafe and could not be sustained.
