The petitioner demonstrated a prima facie case by showing he held title to the suit property since 1997 and that his rights may have been infringed by the subsequent registration of the 1st respondent as proprietor without his participation. The court held that both parties had competing titles, but the first in time principle and the need to scrutinize the root of title justified preservation of the property.
