Ratio Decidendi

The court found that the respondent failed to demonstrate any lawful basis or due process for the claimant's summary dismissal. The claimant was not given an opportunity to respond to the allegations against him, and the respondent did not participate in the proceedings to justify the termination. In the absence of a defence and in light of the claimant's acquittal in the related criminal matter, the court held that the termination was unlawful and unfair. The claimant was therefore entitled to relief, including salary in lieu of notice and compensation for unlawful termination, as well as costs of the suit.
