The evidence showed that the claimant refused to take up a position at the Workshop due to personal inconvenience and subsequently wrote a letter seeking his dues, which the court interpreted as constructive desertion rather than termination by the employer. The contract provided for fortnightly payment, and thus a fortnight's notice was applicable. Since the claimant was not terminated by the employer but left employment voluntarily, he was not entitled to salary for the unexpired contract period but was entitled to terminal dues calculated at the time of separation.
