RULING
1. The Petitioner’s appeal vide Kisumu High Court Criminal Appeal No. 32 of 2012 against conviction and sentence was dismissed on merit. He did not appeal to the Court of Appeal. He now seeks for resentence. I find the petition herein incompetent. The same is hereby dismissed
