The Tribunal recognized the severe impact of the covid-19 pandemic on the Tenant's bar business, which led to closure and financial hardship. The Landlord had already reduced the rent in recognition of these circumstances. The Tribunal determined that the Tenant should be allowed to pay half of the outstanding arrears (Kshs 180,000) within thirty days and liquidate the balance in monthly instalments of Kshs 40,000, while continuing to pay the normal rent.
