Procedural Posture

Employment Cause / Judgment

  1. 1 Whether the claimant’s employment was unlawfully declared redundant.
  2. 2 Whether the claimant is entitled to the reliefs sought, including salary in lieu of notice, leave, gratuity, and penalty.

Ratio Decidendi

The court found that the claimant's termination on grounds of redundancy was unlawful because the respondent failed to serve a written redundancy notice to both the claimant and the area Labour officer, as required by Section 16A of the repealed Employment Act. The court further held that while the claim for salary in lieu of notice was admitted and thus allowed, the claim for leave was partially allowed based on the contract and evidence of leave days accrued in 2007. The claims for gratuity and penalty were dismissed due to lack of evidence and substantiation. The court awarded the claimant a total of Kshs. 37,900.65 plus costs and interest from the date of filing suit.

Court Disposition

Claim partly allowed for the claimant.

Orders
