Procedural Posture
Notice of Motion / Interlocutory Ruling on Application for Preservation of Status Quo Pending Hearing
Legal Issues
- 1 Whether the court should grant an order to maintain the status quo in a boundary dispute pending the hearing and determination of the suit.
Ratio Decidendi
The court found that, given the nature of the dispute as a boundary issue, it was appropriate to preserve the status quo to prevent any party from altering the subject matter of the suit before the main hearing. This would ensure that the rights of both parties are protected and that the court can adjudicate the dispute without interference or prejudice resulting from changes to the land in question. The court therefore ordered that the status quo be maintained until the hearing and determination of the suit.
Court Disposition
interlocutory order granted; status quo to be maintained
Orders
- The parties shall maintain the status quo currently prevailing until the hearing and determination of this suit.
- The parties are to be allocated a date for pre-trial conference.
