The court found that the 2nd Defendant did not comply with Order 9 Rule 9 of the Civil Procedure Rules, which mandates that after judgment, a party wishing to change advocates or act in person must obtain leave of the court or file a consent between the outgoing and incoming advocates. The death of the previous advocate did not exempt the 2nd Defendant from this requirement. The proper procedure would have been to seek leave of court or for any party to apply for an order declaring that the advocate had ceased to act due to death.
