The evidence presented by the Respondent regarding alleged misconduct was unsubstantiated and speculative, with no admissible proof of wrongdoing or breach of contract by the Claimant. The summary dismissal was therefore both substantively and procedurally unfair. The Claimant was entitled to compensation for unfair dismissal, payment in lieu of notice, unpaid leave, and salary for days worked.
