Procedural Posture

Miscellaneous Application / Ruling on Application for Stay of Execution and Leave to Appeal Out of Time

  1. 1 Whether the applicant has satisfied the conditions for grant of stay of execution pending appeal.
  2. 2 Whether the applicant should be granted leave to appeal out of time against the summary judgment.
  3. 3 Whether the delay in filing the application was unreasonable or excusable.

Ratio Decidendi

The court found that the applicant met the requirements for stay of execution pending appeal. The delay in filing the application was excusable given the Covid-19 pandemic and restrictions on movement. The court accepted that the applicant's shares held by the respondent could serve as security, and the amount surcharged was substantial. The court balanced the interests of both parties and granted the stay of execution on condition that the applicant deposits Kshs. 2 million as security in a joint interest-earning account within 30 days. Failure to comply would result in the lapse of the stay orders, allowing the respondent to proceed with execution. Costs were awarded to the respondent.

Court Disposition

Application allowed with conditions.

Orders

  • In the event of failure to comply with the above condition, the stay orders shall lapse and the respondent shall be at liberty to proceed with execution.
