Ratio Decidendi

The applicant failed to provide sufficient evidence of his inability to pay the decretal sum at once, as required by law. However, since the respondent does not entirely oppose payment by instalments, the court exercises its discretion to allow payment by instalments on terms it considers just. The applicant is ordered to pay an initial lump sum followed by monthly instalments, balancing the interests of both parties and the need for expeditious settlement of the taxed costs.
