The court held that any cause of action accrued in 2005, and under Section 4(1) of the Limitation of Actions Act (Cap 22), the claim should have been filed within six years, i.e., by 2011. Since the claim was filed in 2013, it was time barred. The court also found no evidence to support the claim of unlawful retirement.
