The court found that the claimant was employed by the respondent from 21st September 1998 to 16th April 2010 and was terminated due to redundancy. The respondent paid only notice pay and failed to pay severance as required by Section 40 of the Employment Act, 2007. The court held that statutory entitlements such as severance pay cannot be waived by a discharge voucher or by the recommendation of a labour officer. The claimant was therefore entitled to severance pay calculated at 15 days' salary for each completed year of service, amounting to Kshs. 78,692. The respondent was ordered to pay this sum within 30 days of the award. No order was made as to costs.
