The court noted that the 5th Defendant (ADC) had not led the process of identifying the respective portions as previously ordered. Without clear identification of the land, the court could not determine with certainty that the Defendants had disobeyed the court order. The Plaintiff did not discharge the higher standard of proof required in contempt proceedings. Consequently, the application for contempt was dismissed.
