Ratio Decidendi

The court found that the Respondents failed to provide adequate reasons for the Claimant's deployment and did not follow the proper disciplinary process if gross misconduct was alleged. The deployment, in the absence of a fair process and consultation, amounted to an unfair demotion contrary to Section 10(5) of the Employment Act. The court held that disciplinary proceedings, not deployment, should have been pursued if misconduct was the issue. Accordingly, the Claimant's application for interim relief was merited, and the relevant deployment and show cause letters were stayed or revoked as prayed.
