Legal Issues
- 1 Whether the application for consolidation or related handling of suits involving the same suit properties but different parties should be granted.
- 2 Whether the file should be placed before the Presiding Judge for directions on disposal of related matters.
Ratio Decidendi
The court found that although the parties in the various suits are not identical, the suits are related as they lay claim to the same suit properties. To avoid conflicting decisions and promote efficient disposal, it is appropriate to have the file placed before the Presiding Judge for directions on the process of disposing of these related matters. The court therefore granted the application to the extent of directing that the file be placed before the Presiding Judge for further directions, and ordered the plaintiff to serve all parties accordingly.
Court Disposition
Application granted in part; file to be placed before Presiding Judge for directions.
Orders
- The file is to be placed before the Presiding Judge on 22/7/2024 for directions.
- Plaintiff to serve all parties.

Ruling
1. Having perused the application and the suit I am persuaded to grant prayer 3 as it is complimentary to prayer 2. I note that though the parties may be different, this suit is related to ELC E267, E268, E264, E263, E266 and another, therefore I direct that the file be placed before the Presiding Judge to guide on the process of disposing of these related matters. The suits have different parties sued and laying claim to the same suit properties. File to be placed before the Presiding Judge on 22/7/2024 for directions plaintiff to serve all parties.
