The court held that the Chief Magistrate's Court lacked jurisdiction to entertain claims for adverse possession under Section 38 of the Limitation of Actions Act. The Environment and Land Court's power to transfer suits under Section 18 of the Civil Procedure Act is limited to suits that were initially filed in courts with jurisdiction. Since the subordinate court was not vested with jurisdiction ab initio, the suit was a nullity and incapable of being transferred. The application to transfer the suit was therefore dismissed as the court cannot breathe life into a suit that was void from the outset.
