Procedural Posture

Stay Application / Ruling on Application for Stay of Execution Pending Appeal

  1. 1 Whether the High Court has jurisdiction to grant a stay of execution after a notice of appeal has been filed in the Court of Appeal.
  2. 2 Whether the application for stay of execution should be made to the Court of Appeal under rule 5(2)(b) of the Court of Appeal Rules.

Ratio Decidendi

The High Court lacks jurisdiction to entertain an application for stay of execution once a notice of appeal has been filed and the Court of Appeal is seized of the matter. The proper forum for seeking a stay of execution in such circumstances is the Court of Appeal under rule 5(2)(b) of the Court of Appeal Rules. The application for stay of execution before the High Court is therefore dismissed for want of jurisdiction.

Court Disposition

Application for stay of execution dismissed with costs to the Plaintiff/Respondent.

Orders

  • The prayer for stay of execution of the judgment rendered on 13th July, 2023 is dismissed with costs to the Plaintiff/Respondent.
