Although the precise contributions of each party were uncertain, the respondent conceded joint contribution in oral evidence. The court held that, in the interests of justice and to avoid the costs of subdivision, each party should retain one of the two properties, with the respondent retaining LOC.14/KIRU/[….] (0.81 Ha) and the applicant entitled to LOC.14/KIRU/[….] (0.60 Ha), with each party bearing their own costs.
