The High Court found that while the trial court was justified in using the minimum wage and a 30-year multiplier due to the deceased's age and lack of documentary evidence of income, it erred by failing to apply a dependency ratio, which is a relevant factor when the dependents are parents. The court held that parents of a deceased child are conventionally entitled to a third of the deceased's anticipated earnings, not the whole. The failure to deduct the deceased's probable living expenses resulted in an excessive award for lost dependency.
