Procedural Posture

Miscellaneous Application / Ruling on Application for Stay of Execution and Leave to Appeal Out of Time

  1. 1 Whether the applicant should be granted leave to file an appeal out of time.
  2. 2 Whether the applicant is entitled to an order for stay of execution pending appeal.
  3. 3 Whether the applicant has demonstrated substantial loss if stay is denied.

Ratio Decidendi

The court found that the applicant had provided a sufficient explanation for the delay in filing the appeal, namely, lack of notice of judgment delivery, which was not controverted by the respondents. The applicant demonstrated that it would suffer substantial loss if stay was denied, as the respondents had not shown capacity to refund the decretal sum if the appeal succeeded. The application was filed without unreasonable delay, and the applicant expressed willingness to provide security. The court exercised its discretion to grant leave to appeal out of time and stay of execution, conditional upon the deposit of the decretal sum in a joint interest-earning account.
