Procedural Posture

Environment and Land Case / Ruling on Notice of Withdrawal and Costs

  1. 1 Whether the plaintiff has an unfettered right to withdraw the suit before judgment is delivered.
  2. 2 Whether the withdrawal of the suit should be allowed without an order as to costs.
  3. 3 Whether the objections by the defendants to the withdrawal are valid.

Ratio Decidendi

The court held that the plaintiff's right to withdraw the suit before judgment is absolute and cannot be fettered by the objections of the defendants, especially where no counterclaim exists and the suit had not been set down for hearing. The only issue for the court's discretion is the award of costs. The court found no prejudice to the defendants or interested party in allowing the withdrawal before the previously scheduled date and no good reason to depart from the general rule that costs follow the event. Accordingly, the suit was marked as withdrawn and costs awarded to the defendants and interested party, to be taxed by the Deputy Registrar.

Court Disposition

Suit marked as withdrawn; costs awarded to defendants and interested party.
