Ratio Decidendi

The court held that the applicant, having already sought review and subsequently appealed the same order, was precluded by law from seeking leave to appeal out of time or to stay execution on the same matter. Section 80 of the Civil Procedure Act and Order 45 of the Civil Procedure Rules make it clear that the remedies of review and appeal are mutually exclusive; once a party opts for review and it is determined, the right to appeal that order is extinguished. The court further found that the issues raised in the current application had already been determined in previous proceedings between the same parties, rendering the matter res judicata under Section 7 of the Civil Procedure Act....
