Ratio Decidendi

The Court of Appeal held that it lacked jurisdiction to entertain a second appeal on the ground of severity of sentence, as this is a matter of fact and not law under Section 361(1)(a) of the Criminal Procedure Code. The appellant's appeal was solely against sentence, and there was no appeal against the summary dismissal by the High Court. Even if the summary dismissal was construed as including the sentence, the Court of Appeal could not intervene. Furthermore, the sentence of ten years imprisonment was considered lenient given the gravity of the offence and the age of the complainant. The appeal was therefore dismissed for want of jurisdiction and lack of merit.
