The Court of Appeal held that the appellant's appeal to the High Court was filed within the prescribed time under section 79G of the Civil Procedure Act when the period of the High Court Christmas vacation (21st December to 13th January) is excluded in accordance with Order 50 Rule 4 of the Civil Procedure Rules. The Court found that the High Court erred in dismissing the appeal as out of time, particularly as the issue was not raised by the parties and the appellant was not given an opportunity to be heard on it.
