Procedural Posture

Civil Appeal / Judgment

  1. 1 Whether the appellants are beneficiaries entitled to inherit from the estate of Oloko Munika, deceased.
  2. 2 Whether the appellants had locus standi to seek revocation of the confirmed grant.
  3. 3 Whether the lower court erred in dismissing the appellants' claim of inheritance.

Ratio Decidendi

The appellants, as great grandchildren of the deceased, failed to prove that they were maintained by the deceased and did not demonstrate that they had obtained letters of administration for their parents' estate. Therefore, they lacked legal standing to claim a share of the estate either as dependents or as representatives of their deceased parents. The lower court was correct in dismissing their application for revocation of the grant, as there was no legal basis for their claim to the estate of Oloko Munika. The appeal was also procedurally incompetent due to an incomplete record of appeal. Consequently, the appeal was dismissed with costs.

Court Disposition

Orders

  • The appeal is dismissed with costs to the respondent.
