Ratio Decidendi

The High Court lacks jurisdiction to review or revise a sentence it imposed while exercising its appellate jurisdiction. Section 362 of the Criminal Procedure Code and Article 165(6) of the Constitution restrict the High Court's revisional and supervisory powers to subordinate courts and do not permit the court to revisit its own decisions or those of courts of equal status. Once the High Court has determined an appeal and imposed a sentence, it becomes functus officio regarding that matter. Therefore, the applicant's recourse, if aggrieved by the sentence, lies in appealing to the Court of Appeal, not by seeking revision before the same court.
