Ratio Decidendi

The court found that the suit by Hilda Nyambura Gathuri had abated due to her death and lack of substitution, and that Civil Appeal No. 179 of 1995 was dismissed. The Murang'a High Court ELC Suit No. 20 of 2017 had conclusively determined ownership of the suit property in favour of Wilson Mwangi Ramson. The respondent failed to provide evidence of any subsisting stay order to prevent execution of the judgment. As such, the restriction (entry number 10) on the land register, which was based on the abated suit and dismissed appeal, no longer had any legal basis. The court therefore allowed the application and ordered the restriction to be lifted, set aside, and/or vacated.
