Ratio Decidendi

The court held that a suit filed in a court without jurisdiction is a nullity in law and cannot be transferred to another court under section 18 of the Civil Procedure Act. The applicant sought to transfer the suit from the subordinate court to the Environment and Land Court on the basis that the subordinate court lacked jurisdiction over the counterclaim. However, the court found that the law is clear: transfer can only be ordered if the original court had jurisdiction at the time of filing. Since the subordinate court lacked jurisdiction, the suit was incompetent and a nullity, and there was nothing to transfer. The application was therefore dismissed as unmerited.
