The Defendant, whose tenancy was lawfully terminated and who failed to vacate after notice, remained in occupation without the Plaintiff's consent, constituting trespass. The Plaintiff was thus deprived of use and possession of the property and is entitled to mesne profits calculated at the rate previously paid as rent by the Defendant for the period of wrongful occupation (January 2020 to March 23, 2022).
