Ratio Decidendi

The Plaintiff failed to prove, on a balance of probabilities, that he was the registered owner of the suit property, as he did not produce a registered lease or certificate of lease. Ownership cannot be established by a sale agreement or unregistered lease alone. Without proof of ownership, the Plaintiff lacked standing to claim mesne profits or service charge. Furthermore, there was no evidence of a landlord-tenant relationship or privity of contract between the Plaintiff and Defendant, precluding any claim for rent or service charge. The Plaintiff's claim was therefore unsubstantiated and could not succeed in law.

Court Disposition

Plaintiff's suit dismissed with costs to the Defendant.
