The Tribunal found that the Appellant filed the Appeal before the statutory period for the Commissioner to issue a review decision had lapsed, as required by Section 229(4) of the EACCMA. The Appellant lodged the application for review on 16th February 2022 and filed the Appeal on 25th February 2022, within only nine days, whereas the Commissioner had up to thirty days to issue a decision. As a result, there was no review decision upon which the Appeal could be grounded, rendering the Appeal incompetent and improperly before the Tribunal.
