Procedural Posture

Tribunal Reference / Ruling on Reference and Application

  1. 1 Whether there exists a landlord-tenant relationship between the applicant and the respondents under the Landlord and Tenant (Shops, Hotels and Catering Establishments) Act.
  2. 2 Whether the applicant is entitled to protection from eviction and interference with her tenancy.
  3. 3 Whether the respondents are entitled to mesne profits for the applicant's occupation of the premises.

Ratio Decidendi

The tribunal found that the applicant failed to establish a landlord-tenant relationship with the respondents as required by law, having never paid rent to them nor shown any authority from them to occupy the premises. The applicant also failed to challenge the eviction order from the Chief Magistrate's Court and did not comply with directions to pay rent to the respondents. As such, the applicant was not entitled to protection under the Act, and her reference and application lacked merit. However, since the applicant occupied the premises, the respondents were entitled to mesne profits for the period of occupation. The tribunal dismissed the applicant's claims and awarded mesne profits...

Court Disposition

Application and reference dismissed; mesne profits and costs awarded to respondents.

Orders

  • The application and reference both dated 11th September 2023 are dismissed.
