Procedural Posture

Environment and Land Case / Ruling on Stay of Proceedings and Substitution of Party

  1. 1 Whether the stay of proceedings issued on 12.2.2013 remains in force in light of subsequent High Court and Court of Appeal decisions.
  2. 2 Whether the application for substitution of the 1st defendant, following his death, should be allowed.

Ratio Decidendi

The court found that the original stay of proceedings issued on 12.2.2013 was predicated on the pending determination of HCCC No. 55 of 2012. The High Court delivered its decision on 11.4.2024, settling the issues of shareholding and directorship in Manchester Outfitters. Subsequent orders on 30.4.2024 directed that all related suits should proceed without delay. Although a temporary stay was granted by the High Court on 15.7.2024, it was limited to 30 days and has since lapsed. The court found no evidence of any further stay from the Court of Appeal or any other court affecting the present proceedings. Therefore, the substratum for the stay no longer exists, and the stay is discharged....

Court Disposition

Stay of proceedings discharged; application for substitution of 1st defendant allowed; suit to proceed to hearing.

Orders
