The court found that although the claimant may have been engaged as a casual worker, his continuous service for more than a month entitled him to the protections of a regular employee under the Employment Act. The respondent failed to provide evidence to support its claim that the claimant was a casual worker engaged only on a need basis. The court accepted the claimant's account that he was dismissed without notice or reason, which constituted unfair termination. Consequently, the court held that the claimant was entitled to one month's salary in lieu of notice and four months' salary as compensation for unfair termination, as well as costs of the suit.
