The court found that although there was an agreement between the parties for a tenancy of 5 years and 3 months, the agreement was not registered as required by law for leases exceeding one year. Consequently, the purported lease was void after the first year, and the relationship between the parties became a periodic (monthly) tenancy, terminable by one month's notice. The defendant gave more than one month's notice before vacating, and was up to date with rent payments at the time of vacating.
