Disputes regarding legal fees between the defendant and the interested party, or the existence of an outstanding water bill, do not affect the enforceability of the undertaking. The undertaking is a separate contractual obligation that must be honoured regardless of such disputes. The responsibility for any outstanding water bill lies with the beneficial owner (Ofafa Maringo Housing Co-operative Society Ltd), not the plaintiff or the defendant. Consequently, the defendant is ordered to pay the plaintiff the outstanding sum with interest and costs.
