The court found that the Appellant and Respondent had a landlord-tenant relationship governed by a letter of intent, which expired on 31st January, 2002. Upon expiry and after due notice to vacate, the Appellant continued to occupy the premises and pay the old rent, despite being notified of the increased market rent. The court held that after the expiry of the tenancy and notice, the Appellant became a trespasser. The Respondent was therefore entitled to mesne profits equivalent to the difference between the market rent and the rent paid for the period of unlawful occupation, amounting to Ksh.460,000/-.
