Procedural Posture

Review Application / Ruling on Application for Review and Joinder

  1. 1 Whether a non-party (the Applicant) has capacity to seek review and setting aside of a judgment.
  2. 2 Whether the Applicant has actionable interests in the suit property warranting joinder.
  3. 3 Whether the issues raised by the Applicant are barred by res judicata.

Ratio Decidendi

The court held that the Applicant, though not a party to the original proceedings, is an aggrieved person within the meaning of Section 80 of the Civil Procedure Act and Order 45 Rule 1 of the Civil Procedure Rules, 2010, and thus has capacity to seek review and setting aside of the judgment. The Applicant demonstrated a direct and actionable interest in the suit property, as the judgment and proceedings adversely affected its rights as a chargee over L.R No. 28223/33. The court found that the Applicant was not afforded an opportunity to be heard, constituting an error apparent on the face of the record and a violation of the right to fair hearing under Article 50(1) of the Constitution....
