Ratio Decidendi

The High Court found that the trial court erred in granting both the main and alternative prayers in the same ruling. Once the main relief (transfer of land) was granted, the court had no mandate to also grant the alternative relief (monetary judgment). The principle, as established by binding appellate authority, is that a court must choose between main and alternative reliefs and cannot grant both. The execution of warrants based on the alternative relief was therefore invalid. The appeal was allowed, and the order granting the alternative prayer was set aside. Each party was ordered to bear its own costs of the appeal.
