The respondent was entitled to a refund of the Kshs. 500,000 deposit paid, together with interest. The trial court erred in awarding interest from the date of the agreement; under Section 26 of the Civil Procedure Act, interest should run from the date of filing suit to the date the money was deposited in court. The appellant's counterclaim was not plausible as the agreement was void ab initio, and the clause for payment of Kshs. 30,000 in case of default was inapplicable.
