Ratio Decidendi

The court found that, although the trial court's sentence was within the law, recent jurisprudence and sentencing policy guidelines require courts to consider the appropriateness of indefinite life sentences, especially where the offender is a first offender, has shown remorse, and the circumstances of the offence do not warrant the harshest penalty. The court held that a definite term of imprisonment is more just and proportionate in this case. The life sentence was therefore set aside and substituted with a term of thirty years' imprisonment, with the period spent in custody prior to conviction to be deducted in accordance with Section 333(2) of the Criminal Procedure Code.
