The trial court imposed default sentences of two to three years imprisonment for each count in lieu of fines of Ksh. 500,000 per count. Section 28 of the Penal Code expressly limits default sentences for fines exceeding Ksh. 50,000 to a maximum of twelve months imprisonment unless a contrary provision exists. The trial court's imposition of default sentences exceeding this statutory maximum was therefore illegal. The High Court found that, had the lawful default sentences been imposed, the appellant would have completed his sentence by August 2022. As a result, the appeal against sentence was allowed, the illegal sentences set aside, and the appellant ordered to be released forthwith...
