The trial court was justified in holding the appellant 100% liable for the accident. On quantum, the court held that although the claim for Kshs. 90,000.00 for hire of a taxi was specifically pleaded, it was not specifically proved by receipts or other documentary evidence, and therefore should not have been awarded. The appeal was allowed only to the extent of deducting the unproven special damages from the total award, with the remainder of the trial court's judgment upheld.
