Ratio Decidendi

The Tribunal found that it could not determine the outstanding rent arrears or the proper rent payable by the tenants until an independent valuation is conducted as previously ordered by the Environment and Land Court (ELC No. 32 of 2015) and the Tribunal itself. The Tribunal noted that no such valuation had been carried out, and therefore, compliance with the court's directive was a prerequisite to resolving the dispute. As a result, the Tribunal ordered that an independent valuer be appointed to assess the rent, with the cost to be borne by the landlord, and deferred the final determination of arrears and other issues pending receipt of the valuation report.
