Ratio Decidendi

The court found that the deposit of Kshs. 449,096.05 was made as a condition for the grant of interim stay of execution pending the hearing of the plaintiffs. application for stay pending appeal. Upon dismissal of that application, the purpose for which the deposit was made ceased to exist. In the absence of any order for stay of execution from the Court of Appeal, there was no lawful or reasonable basis to continue withholding the funds from the defendants. The court therefore held that the defendants, as the successful litigants, were entitled to the release of the deposited amount together with accrued interest, and awarded them costs of the application.
