Civil Appeal / Ruling on Notice of Motion to Remove Caution and Restrictions

  1. 1 Whether the caution and restrictions placed on land parcels Igoji/Kinoro/1324 and Igoji/Kinoro/1325 should be removed following the conclusion of related court cases.
  2. 2 Whether the applicant is entitled to enjoy the fruits of judgment after the finalization of Civil Appeal No. 44 of 2011 and Misc. Civil Application No. 307 of 2009.

Ratio Decidendi

The court found that the cautions and restrictions were placed on the suit properties to preserve them during the pendency of related court cases. Since both Civil Appeal No. 44 of 2011 and Misc. Civil Application No. 307 of 2009 have been finalized in favour of the applicant, there is no longer any justification for maintaining the cautions and restrictions. The applicant, as the registered owner, is entitled to enjoy the fruits of the judgments. The application to remove the caution and restrictions is therefore merited and allowed.
